What is surveillance?
As we mentioned at the outset, surveillance is a relatively broad term. The law often refers to surveillance as "television surveillance". According to the Television Surveillance Act, television surveillance covers the surveillance of persons that occurs continuously or is repeated at regular intervals by means of a remote-controlled or automatically operating camera.

Rules for monitoring private land

In addition, it is also not legal to monitor public areas. This could, for example, be the sidewalk. Therefore, you need to be careful and cautious when setting up video surveillance on your private plot.
It may also be worthwhile to set up signage with your plot video-monitored. However, this is not a legal requirement.
Rules for monitoring companies
As a company, whether you work in a café with guests or in an industrial area, there should always be a sign that there is video surveillance (both inside and outside).

New rules for monitoring in 2018
In addition, in 2018, it was made legal for traders to share video material from burglary or attempted burglary with other companies. That way, one could make his neighbors aware of thieves in the area.
The change was made just to be able to warn each other about the movements of criminals in the area. However, a number of requirements must be met for it to be legal to share these videos with others:
#1 The footage may only show the persons suspected of committing something criminal (eg burglary). Other people in the picture who can be seen and identified must be obscured or removed.
#2 The criminal act must first be reported to the police before the footage can be shared.
#3 You must have a reasonable belief that the person on the recordings will commit crime with the companies with whom you may share the recordings.
#4 If you share your video material, do so in closed and secure systems. Do not share the footage through the cloud or on social media. A USB stick is an approved method
